As Ms Collett had admitted the breach we find the charge proved.
Penalty:
Accordingly we suspend Ms Collett’s riding license to take effect after racing at Ellerslie on 10 January until after racing on 17 January 2015 - 4 days.

Facts:
Following the running of race 6, the GOLDRIDGE MARINE FARM 2000 an Information was laid by Stipendiary Steward Mr A Coles. The respondent, Ms S Collett was alleged to have ridden her mount MR CHEZ outwards near the 800 metres, buffeting DARTING ridden by Ms S Spratt.
Ms Collett was present at the hearing and acknowledged that she understood the Rule and that she admitted the breach.
Rule 638(1)(d) states ' A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless'.
Senior Stipendiary Steward, Mr J Oatham demonstrated the incident on the available video films. He pointed out that at about the 800 metre mark Ms Collett, riding MR CHEZ was in a 2 wide position. Ms Spratt, riding DARTING was on her outside. It was evident that MR CHEZ was travelling well and that Ms Collett was attempting to make room for herself to improve her position. As she angled her mount outwards she made contact with DARTING as she attempted to push that horse out. Ms Spratt was entitled to hold her position, however was eventually forced to give way to MR CHEZ as Ms Collett continued to ride that horse forward. Mr Oatham made the point that while DARTING had not been travelling as well as MR CHEZ that did not give Ms Collett grounds to put pressure on that horse, given that there was only about 3/4 a length between them at the time.
Ms Collett acknowledged that she was only about 3/4 of a length ahead of Ms Spratt, and that she had admitted the breach. However she added that in her opinion she had only 'unbalanced' Ms Spratt, not checked her. She added that her mount had been travelling well at the time and in fact had gone on to win the race.
Submissions for Penalty:
Mr Coles advised the Committee that Ms Collett’s record was very good. He said she was a very busy rider who rode extensively throughout the North Island. She had not faced a careless riding charge within the past 12 months. Mr Coles added that the Stewards placed the level of carelessness in this matter at the lower end of the scale and believed a period of suspension of 4 days riding would be an appropriate penalty. Balancing these factors, Mr Coles added that it was an aggravating factor that Ms Collett had continued to ride her mount forward when clearly putting Ms Spratt under pressure.
Ms Collett had nothing to say regarding a likely penalty, however she advised the Committee that she wished to ride at Ellerslie on 10 January and asked that any suspension commence after that day.
Reasons for Penalty:
The Committee took into account the submissions made and also viewed the incident on all of the available films. While we agreed that the incident was at the lower end of the scale, it was an aggravating factor that Ms Collett had not relieved the pressure on Ms Spratt and had continued to ride her mount forward. We accepted that Ms Collett has an excellent record given the number of rides she takes throughout the North Island. To her credit Ms Collett made a frank admission of the breach when first interviewed by the Stewards.
Balancing all of these factors we believe a period of suspension of 4 days would be an appropriate penalty.
