The placings became:

1st - HIGH IN THE SKY

2nd - THANK YOU

3rd - DEBBIE LEE GALLEON

4th - PHOEBE MAJESTIC

Authority was given for dividends and stakes to be paid in accordance with the amended placings.

Facts:

A protest was lodged following Race 10, alleging that the horse SOLEDAD, which finished 5th, had broken in excess of 50 metres in the final 200 metres of the race.

Mr T Mitchell, driver of the horse and representing the connections signed the Information to the effect that he did not contest the protest and did not wish to be present at the hearing.

Rule 870(3) states 'Any horse which breaks from its gait shall promptly regain its proper gait'.

The Breaking Horses Regulations (b) provide 'Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to regain its proper gait'.

Submissions for Decision:

Referring to the film of the race Mr Mulcay identified the horse SOLEDAD as it neared the 70m mark. The horse then went off stride and galloped to the finish, eventually finishing in 5th placing, in a gallop.

Reasons for Decision:

The horse galloped in excess of 50 metres and was therefore in breach of the Rule and Regulations.
