Decision:

The committee rules the horse EUROMAX was not denied a fair start and advise the Stipendiary Stewards accordingly.

Facts:

At the conclusion of Race 2 The Sonya McLachlan Equine Dentist Trot an information A1733 was lodged by Senior Horseman Mr T Williams (EUROMAX) alleging that EUROMAX was denied a fair start and its chances were materially affected.

The rule reads 213(I)(J):

A Stipendiary Steward at any time may scratch from a race or declare ineligible to start in a race until a specific condition is met any horse on all or any of the following grounds.

(J) A horse was denied a fair start and such occurrence materially prejudiced the chances of that horse.

Submissions for Decision:

The Committee was shown the video clips of the alleged incident, however after a short viewing, technical issues prevented the committee any further viewing until after the scheduled race time start of Race 4.

The Committee heard evidence from Mr Tim Williams (EUROMAX) who stated that he believed his horse was not on the race track at the time the starting barrier strands were released.

Mr Williams also said he yelled to the starter just prior to the starting tapes being released.

Mr B Ward (Starter) stated he heard Mr Williams and looked across, however he believed EUROMAX was in his starting position, which was the number 4 position on the unruly mark. Mr Ward was aware the horse was backing away through his own behaviour and he was aware that he did not receive any interference from any other horse.

The starter's assistant (Mr Popham) was on the inside of the track and did not hear Mr Williams call out.

Eventually the committee had to view the video clips in the TAB trackside truck, where the video clip froze again, delaying a decision and the start of Race 4 until six minutes after the scheduled starting time.

Reasons for Decision:

The committee was satisfied that the horse (EUROMAX) was the author of its own demise, in that it backed away sideways just as the barrier strands were released. At this time the horse itself was on the race track but the wheels of the cart were at the top of the slope leading to the ditch to the outside of the track.

The horse had suffered no interference from any other horse and was not being held by the starter's assistants.
