Wellington RC 18 January 2020 – R 7 – Chair, Mrs N Moffatt

Code:
Thoroughbred
Meet Title:
Wellington RC - 18 January 2020
Meet Chair:
NMoffatt
Meet Committee Member 1:
NMcCutcheon
Race Date:
2020/01/18
Race Number:
R 7
Decision:
As Mr Grylls admitted the breach, it was deemed to be proved.
Penalty:
Accordingly, Mr Grylls' license is suspended from the close of racing on Saturday, January 25th 2020 up to and including racing on Thursday, February 20th 2020. He is also fined the sum of $750.
Facts:
Following the running of Race 7 (Group 1, JR & N BERKETT TELEGRAPH), an Information was lodged by Mr Oatham alleging a breach of Rule 638 (1) (d) in that C Grylls (SPRING HEAT) angled his mount outward near the 200m forcing WINTER BRIDE (R Maloney) out into the line of THE PRECIOUS ONE (L Allpress) which was checked.
Mr Grylls confirmed his understanding of the charge and said that he admitted the breach.
Mr Oatham had Stipendiary Steward Mr Goodwin identify the runners involved and explain the incident using all available video angles. He showed Mr Grylls (SPRING HEAT) racing in a position approximately 3 off the fence at the 200 metres. He was held up for a run in behind other runners and angled his mount outwards to make his own run. In doing so, Mr Grylls dictated Mr Maloney outwards into the line of Mrs Allpress on THE PRECIOUS ONE which was checked.
Mr Grylls admitted pushing out but said his mount was improving significantly and he had runners to his inside and outside who were not going anywhere. He said once he came outside of JULIUS he didn’t push out any further, but WINTER BRIDE overreacted and continued to move out further which made the incident look worse.
Submissions for Penalty:
Mr Oatham produced Mr Grylls' riding record, which showed 758 rides within the last 12 months and three careless riding breaches as follows:
2/3/19--Auckland-7 days
17/4/19-Matamata-5 days
25/5/19-Auckland-6 days
The Stewards considered today’s infringement to be towards the high end of carelessness due to the abrupt manner in which Mr Grylls moved outwards.
In response to a question from the Committee, Mr Oatham said WINTER BRIDE finished 5th, and THE PRECIOUS ONE finished well back in the field. The rider OF THE PRECIOUS ONE, Mrs Allpress, told the stewards that her horse was a beaten runner at the time of the interference.
Mr Oatham’s submission was for a term of a suspension with the addition of a monetary penalty.
Mr Grylls was invited to make submissions on penalty. He reminded the Committee that his last suspension was back in May 2019 and said he considered himself a very careful rider who is always aware of other riders around him. In respect to the incident today Mr Grylls said that while he admitted the breach, he believed WINTER BRIDE overreacted and made it look worse.
Mr Grylls advised of riding commitments through until next Saturday, January 25th.
Reasons for Penalty:
The Committee considered all submissions including Mr Grylls' admission of the breach.
In our opinion, the incident was high end. Mr Grylls angled out abruptly and forced a run where there was none available. As a result WINTER BRIDE was forced several horse widths out into the line of THE PRECIOUS ONE who received a relatively severe check.
It was our observation that Mr Grylls did take some corrective action, but it was well after the event and the damage had already been done. Following the incident, WINTER BRIDE regained its momentum and ran on well to finish in 5th place.
We adopted a starting point of 10 days in accordance with the Judicial Penalty Guide. Aggravating factors were the Group 1 status of the race, and Mr Grylls' third placing, after forcing his own run.
His record we considered a neutral factor based on the number of rides and the 8 months since Mr Grylls’ last careless riding charge.
Balancing up all factors, it was our opinion that a suspension of 15 days was appropriate along with a monetary penalty.
