Following the running of Race 2 (Monstavision Supporting Life Education Trust Hwt), Information A14562 was filed with the Judicial Committee. It was alleged that Mr Downs used his whip excessively prior to the 100m.
Mr Downs said that he understood the Rule, Charge and confirmed that he admitted the breach.
Mr Goodwin showed the film replays and said that Mr Downs had struck his mount 8 times prior to the 100m (5 is the limit). He added that the horse BLANCO BAY was also racing out of contention (back second to last).
Mr Downs agreed with the Stipendiary Stewards submission.

Mr Downs said that he was not sure that the total was 5 times prior to the 100m. He added that his mount hung out on the home turn and had lost a front shoe.

The Committee took into account the number of strikes, plus the fact that the horse was racing out of contention when considering penalty. In light of these features it was determined that a fine of $350 be imposed.
