As the respondent has admitted the breach we find the breach proved.

Mr Hanson is fined the sum of $200.

Facts:

Following the running of race 6, the Mike Hurring Logging Ltd Handicap Trot, an Information was lodged by Co-Chief Stipendiary Steward, Mr N McIntyre alleging a breach of r 864(2)(d) in that licensed trainer “Mr R Hanson (BONO HEST ) failed to affix the rein as not to come off. This resulted in the gelding being scratched after bolting in the preliminary.”

Mr Hanson admitted the charge and did not wish to appear.

Mr McIntyre stated that BONO HEST went onto the track prior to the start. Approximately 200 metres into its preliminary Ms S Ottley took a hold of the horse only to find that one rein had not been properly affixed to the bridal. As a result BONO HEST bolted for between three and four rounds before being stopped with the aid of the mobile barrier. He said Ms Ottley and other horses/drivers on the track were put at considerable risk. Fortunately no horse or driver was injured although BONO HEST was distressed and had to be scratched from the event.

Mr McIntyre stated that under normal procedure the breach of the Rule would be dealt with by way of a Minor Offence Notice. However due to health and safety concerns the Stewards took a more serious view of this incident, hence an information was filed.

Submissions for Penalty:

Mr McIntyre said Mr Hanson had no previous breach of this rule, had a clean record and had admitted the charge at the outset. However, he said Ms Ottley had been placed in a dangerous situation. The fine for an offence under a Minor Offence Notice was $100. On this occasion due to the serious health and safety issues, he was seeking a fine between $150 and $200.

Reasons for Penalty:

The Committee had regard to Mr Hanson’s early admission of the breach and his excellent record. However, we take into account that Ms Ottley was placed in a dangerous position, with other drivers’ and horses’ safety being at risk, and the penalty should reflect that. A fine at the higher end of the scale submitted by Mr McIntyre to be appropriate, is necessary.
