As Ms Schofer admitted the breach, it was deemed to be proved.

Accordingly, Ms Schofer’s license is suspended from the close of racing on Saturday February 27th, up to and including racing on Friday March 12th, 2021 (6 days). In addition, she is fined the sum of $500.
Facts:
Following the running of Race 2 an Information was lodged by Mr Oatham alleging a breach of Rule 638 (1) (d) in that H Schofer (JOY ALONE) angled her mount outward passing the 600 metres when not clear of UP “N” POWER (J Fawcett) which was checked which in turn hampered UNDER HER SPELL (J Kamaruddin).
The back-tower and turn-tower videos highlighted the incident best. Mr Goodwin showed where Ms Schofer angled her mount outwards near the 600m when not clear of Ms Fawcett who lost 4-5 lengths when placed in restricted room. Ms Fawcett in turn dropped back onto Mr Kamaruddin who was forced wide on the turn as a result.
Ms Schofer said she had little space and was getting desperate for a run when she angled outwards. She was not aware there was a horse outside of Ms Fawcett.
Ms Clapperton explained that Ms Schofer’s mount was travelling better than that of Ms Fawcett's to her outside. It was unfortunate for Ms Schofer that she angled out for a run at the same time that Ms Hirini improved to the outside of Ms Fawcett leaving no room for Ms Fawcett.

Mr Oatham presented Ms Schofer’s riding record which he described as excellent. She has been an Apprentice Rider since May 2019 and has had 347 race-day rides. Today was her first breach of the Careless Riding Rule. The Stewards placed the degree of carelessness in the mid to high range.
Ms Clapperton said Ms Schofer was aiming to win the apprenticeship and asked the Committee to consider a higher fine and fewer days suspension.
Ms Schofer advised of riding commitments through until Otaki on February 27th.
Reasons for Penalty:
The Committee considered all submissions. It was our opinion that today’s incident was above midrange but not at the high-end level. We based this on the fact that two horses’ chances were significantly affected especially the mount of Ms Fawcett. Ms Schofer found herself in restricted room and desperate to get clear she angled out sharply before going on to win the race. The two horses affected in the incident did not feature in the finish.
We adopted a 7-day starting point and reduced this by one day for Ms Schofer’s excellent record. It is not common practice for Judicial Committees to increase fines in lieu of fewer days suspension, and the Committee did not think it appropriate to do so today.
