After taking all of the above into account we impose a fine of $200.

Facts:

Following race 3 the informant Mr J Oatham lodged an information pursuant to 638(3) (b).  He alleged that Mr M Cameron used his whip in an excessive manner when riding REGALO REAAL.

Submissions for Decision:

Mr Oatham demonstrated the video films and pointed out to the committee Mr Cameron riding REGALO REAAL striking his mount approximately 12 times prior to the 200 metres.  Mr Oatham submitted that Mr Cameron had failed to give his mount the required respite.
Mr Cameron in admitting the breach said his mount was lazy and he was simply pushing forward to win the race.

Mr Oatham said Mr Cameron had a clear record under this rule and submitted his carelessness was at the low end.  He believed a fine of $150 to $200 would be appropriate.
Mr Cameron had nothing further to add.

Reasons for Penalty:

The committee considered all the evidence and submissions.  We explained to Mr Cameron that the new JCA penalty guide, effective from June 1, recommended a fine of $300 for a first offence under this rule.  However in this case there are several mitigating factors to consider.  These include Mr Cameron's clear record under this rule, his admission of the breach and his offending which we believe was at the low end.
