Penalty:
It was explained to Mr Kasim that the starting point for careless riding is now 5 days. After considering all the above factors we impose a suspension on Mr Kasim from riding in races which is to start after racing on 23 February and conclude after racing on 2 March 2011(4 days).

The informant Mr M Williamson alleged that near the 1400 metres Mr Kasim permitted his mount FIG JAM to shift in when not clear of ALEGRIO crowding that runner in onto ONE FOR THE MONEY which was checked.
Submissions for Decision:
Mr George demonstrated the video films and pointed out to the committee FIG JAM ridden by Mr H Kasim racing in a 3 wide position approaching the 1400 metres. Mr George said that Mr Kasim eased back at this point and rolled in taking the line of ALEGRIO (A Collett) when insufficiently clear of that runner. This resulted in ALEGRIO being forced in and checking ONE FOR THE MONEY (C Parish).
Mr Kasim said he looked in and thought there was enough room for him to move in when he did.
Mr Clarken said he conceded Mr Kasim had moved in slightly but believed that Miss Collett had contributed to the incident by also moving in.

Mr Williamson said Mr Kasim had incurred 3 suspensions in the last 12 months. He said this was an average record but conceded that on this occasion Mr Kasim's carelessness was at the low end.
Mr Kasim said he had commitments until after racing on 23 February 2011. When questioned he told the committee he only rode in the North Island which was confirmed by Mr Clarken.

Mitigating factors are Mr Kasim's admission of the breach and the contribution to the incident from Miss A Collett's mount. Aggravating factors include the interference to 2 runners through Mr Kasim moving in when not sufficiently clear.However the committee is satisfied Mr Kasim's carelessness was at the lower end.
