Facts:
Mr Allison alleged that horse number 1, SUPABET (Mr Kerr), which was placed 4th by the Judge in race 8 interfered with the chances of horse number 8, ARMA LEGEND, placed 5th, in that SUPABET broke with approximately 250 metres to run and failed to settle and then locked wheels with ARMA LEGEND.
The margin between 4th and 5th was 1 ¼ lengths.

Rule 869(8) states:
The Judicial Committee may in addition to any other penalty which may be imposed pursuant to r 1003 thereof place any horse which:
(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.
Submissions for Decision:
Mr Allison demonstrated on the videos that shortly before turning for home SUPABET galloped and locked wheels with ARMA LEGEND. He estimated the horse continued in a gallop for some 110 metres and the wheels remained locked during this time. Mr Allison expressed his concern at the length of time Mr Holmes (the driver of ARMA LEGEND) was held up. He said Mr Holmes should have been driving his horse out to the finish but he had been unable to do so.
Mr Holmes confirmed that he had locked wheels with SUPABET and that this was over the distance identified by Mr Allison. He said his horse was “travelling quite well” at the time. The horse was certainly not spent. He said while he was well and truly beaten home, he believed he would have finished in a better placing had he been able to drive his horse out.
Mr Kerr said SUPABET had lost its footing on the turn and had galloped. He accepted that SUPABET and ARMA LEGEND had locked wheels and that ARMA LEGEND was impeded for some distance. Mr Williamson agreed with Mr Kerr’s description of events.
Reasons for Decision:
In exercising our discretion and relegating SUPABET to behind ARMA LEGEND we are satisfied that ARMA LEGEND was impeded for a distance of approximately 100 metres on the final bend and after the horses straightened for the run home when SUPABET galloped and the two horses locked wheels. There was thus a significant period of time when Mr Holmes was unable to drive ARMA LEGEND out to the finish. The progress of ARMA LEGEND was clearly affected, as was the chance of the horse finishing in a better placing.
