As Mr Waddell admitted the breach we found the charge proved.

Mr Waddell is fined the sum of $250.

Facts:

Following the running of Race 5 (Aon Insurance Brokers 1200) an Information was lodged by Mr N Goodwin alleging a breach of Rule 636 (d) in that jockey J Waddell did not ride his mount VEE TWELVE out fully to the finish when able to do so.

The rule reads:

636 (1) A person:

(d) being the Rider of a horse in a Race, must ride his horse out to the end of the Race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared;

Mr Goodwin showed the video of the race from the home turn. Mr Waddell was well back in the field of seven runners but riding his mount out and giving it every opportunity. Upon reaching the 50m mark he relaxed his ride and was passed by POWERBALL. Mr Waddell ran 6th with POWERBALL in 5th place, the margin between the two runners being a neck.

Submissions for Penalty:

Mr Goodwin submitted that a fine was an appropriate penalty. He said the difference in prize money to the owners of VEE TWELVE was $250.

Mr Waddell said he thought he would probably have been beaten anyway but admitted making a silly mistake. He said he prided himself on always riding strongly to the line and this was his first breach of the rule in 17 years of riding. While not making excuses, Mr Waddell said today was his 6th day in a row riding and it was an extremely hot day.

Reasons for Penalty:

The Penalty guide for Judicial Committees has a sliding scale of starting points relating to the potential placing deemed to have been lost. In the case of Rule 636(1) (d) the starting point is $300 for 5th place. We have given Mr Waddell credit for his clear record under this rule over a long riding career. We have also taken into account the money lost by the connections.
