Facts:

Following the running of Race 1, an Information was lodged by Mr Allison, against the fourth placing of horse number 8 (SIENNA SUN), driven by Miss Lauren Pearson, on the grounds that with approximately 55 metres to run, SIENNA SUN broke and remained in its incorrect gait for the remainder of the race. Miss Pearson contested the protest (on behalf of the connections).

Submissions for Decision:

Mr Allison demonstrated the incident by the use of video films. Mr Allison stated that this was a close call, he commented that the horse (SIENNA SUN) had broken close to the fifty metre marker, but because of the film angle, which was at approximately 45 degree angle, front on, it was extremely difficult to tell exactly where the horse was in the incorrect gait. Video film shown from a different angle was also inconclusive.

Miss Pearson gave evidence to the same effect, namely that because of the camera angle, it was impossible to tell exactly where the break had occurred.

Reasons for Decision:

The Committee found that there was sufficient doubt with regard to the exact starting point of the horse (SIENNA SUN) breaking. The Committee found that the evidence of the Video Film was inconclusive.

The exact point where SIENNA SUN was in the incorrect gait, was extremely hard to ascertain, there being no track marker on the outside of the track, which was directly opposite the inside track 50 metre marker.
