Decision:

Accordingly, the Committee declared MARIOTA to be a non-starter.

Facts:

Following the running of Race 4, TRANSPORT MECHANICAL WAHAROA LTD 1400, Stipendiary Steward, Mr B Jones, lodged an Information requesting a ruling in relation to Rule 632 to determine whether MARIOTA was denied a fair start.

Rule 632 provides “If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placing’s was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter.”

Submissions for Decision:

Mr Jones read the Rule aloud to all parties present.

Mr Jones demonstrated on the video footage that when the start was effected a Barrier Attendant still had a hold of MARIOTA’s near side ear. As a result that runner was slow to begin losing 3 lengths. He added that MARIOTA was fractious prior to the start and that is why there were 2 Barrier Attendants up with the horse.

Mr Hennessy said it was clear on the video footage that when the start was effected a Barrier Attendant still had a hold of MARIOTA’s ear. He said as a result MARIOTA’s head was on the side which denied the horse a fair start.

Mr Moody said that MARIOTA was fractious prior to the start. However, he stated that the Barrier Attendant held onto MARIOTA’s ear for a fraction too long. He confirmed that he followed his standard procedure of calling out “watch your gates” prior to the start being effected.

Ms Fawcett said that when the start was effected MARIOTA lost ground because the Barrier Attendant had a hold of her mount's ear. She said MARIOTA was denied a fair start.

Reasons for Decision:

The Committee considered the submissions presented and reviewed the video footage.

The video footage showed that MARIOTA was not slow away by her own accord.

The Committee was satisfied the video footage showed that when the gates opened a Barrier Attendant still had a hold of MARIOTA’s ear. The Barrier Attendant released his hold too late and as a result MARIOTA jumped out awkwardly and lost approximately 4 lengths.

NZTR Starters Manual 6.21 Barrier Attendants at the Jump states:

“If still in the starting gates or alongside horses, Barrier Attendants shall immediately release any hold they may have of a horse as the gates commence to open”.

After taking into account all the above factors the Committee was satisfied that MARIOTA was denied a fair start.
