Ms Andrew’s Jockey’s License was suspended from the end of racing on 29 January through to the close of racing on 7 February 2020.
Facts:
Following the running of Race 6 (Club NZ 1600) Information No. A12309 was filed with the Judicial Committee. The Informant alleged that Ms Andrew the Rider of IVAN KANE failed to ride her mount out to the end of the race when there was a reasonable chance of finishing 4th.
Ms Andrew acknowledged that she understood the Rule, the Charge and confirmed that she did not admit the breach.
As it was a defended hearing the process and Ms Andrew’s rights were explained to her by the Chair.
Submissions for Decision:
Mr Jones showed all films and identified Ms Andrew and her mount on entering the home straight. He said that IVAN KANE had been in or near the lead and in the run down the straight Ms Andrew had ridden with her normal vigour. Then with approximately 2 ½ strides to travel Ms Andrew stopped riding out and stood up with the horse on her outside beating her for 4th placing by a nose. Mr Jones said that if Ms Andrew had have ridden out to the end of the race she may have finished 4th.
Ms Andrew did not question the evidence of Mr Jones.
Ms Andrew for her part said that she was under the impression from her peripheral vision, that she was already headed and beaten for 4th when she stopped riding, as the horse on her outside had past her.
Summation
Mr Goodwin said that Ms Andrew had relaxed her ride for 2 strides off the post and that it was a difficult one. He said that he was not sure that the outside horse had past Ms Andrew when she stopped. He said Ms Andrew’s mount may have finished 4th if ridden out fully.
Ms Andrew’s only comment was “it won’t happen again”.
Reasons for Decision:
After considering all of the evidence the Committee was satisfied that Ms Andrew had stopped riding her mount out short of the winning post, when there was a reasonable chance of the horse finishing in 4th placing.
Submissions for Penalty:
Mr Goodwin said that Ms Andrew had a very good record with this charge under Rule 636(1)(d) being her first.
Ms Andrew said that she would like any suspension imposed to start after 29 January.
Reasons for Penalty:
Taking into account the JCA Penalty Guideline and all other matters relative to penalty for the particular breach, it was deemed that a 5-Riding Day suspension was a suitable penalty.
