We find the charge proved. 

Penalty:

Balancing these matters, we fine Mr Dunn the sum of $250. 

Charge:

Mr Renault alleged that Mr Dunn (BELKMYSTER) shifted ground inwards after approximately 200 metres striking the wheel of MAJORS BLUE JEAN causing BELKMYSTER to break and lose its chance. 

Facts:

Mr Renault had Mr Allison, stipendiary steward, demonstrate on the video that as the field was settling into position shortly after the start Mr Dunn was easing his horse down on the track when the near front leg of his horse came into contact with the cart of MAJORS BLUE JEAN. 

Submissions for Decision:

Mr Renault said it was a miscalculation by Mr Dunn, who had agreed when questioned that he was never in a position to slot in behind MAJORS BLUE JEAN. He had realised this too late. 

Reasons for Decision:

Mr Dunn admitted the charge and indicated on the information that he did not wish to be present at the hearing. 

Submissions for Penalty:

Mr Renault produced Mr Dunn’s record, which was clear under this rule in the past 12 months. He stated when regard was had to the fact that the respondent had had over a 1000 drives in this time, this was an excellent record. He submitted a fine of $250 was appropriate. 

Reasons for Penalty:

Mr Dunn has allowed insufficient room between BELKMYSTER and the cart of MAJORS BLUE JEAN when he was easing his horse down on the track looking for field position. His miscalculation is correctly identified as careless. There has been contact between cart and horse and this has cost the connections and the public who invested on BELKMYSTER, as that horse has galloped and lost its chance.

We agree that Mr Dunn’s record is excellent and this plus his ready admission of the breach are factors in his favour.
