As Mr Harris admitted the breach, the Committee found the charge proved.
Penalty:
Mr Harris had his license to ride in races suspended for a period to commence after racing on the 9th of April and conclude after racing on the 19th April 2018.
The 11th of April was not included in Mr Harris' suspension as it was an apprentice only riders day.
Facts:
Following the running of race 8, Roger Gill Agriculture 1600, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Mr Harris allowed his mount EXECUTIVE POWER to shift in when not sufficiently clear of BLANCO BAY which was checked, and OSTRAVA which was hampered and steadied, losing ground as a result near the 1100m.
Mr Harris acknowledged that he understood the Rule and confirmed his admission of the breach.
Rule 638(1)(d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Jones demonstrated the incident using the available video footage. He identified the horses EXECUTIVE POWER (T.Harris), BLANCO BAY (S.Spratt) and OSTRAVA (M.McNab). Mr Jones showed that near the 1100m Mr Harris looked to his inside a couple of times before shifting ground into the line of BLANCO BAY which had to check and in turn shifted in onto OSTRAVA which was hampered and checked.
Mr Jones submitted that Mr Harris was not his own length and one length clear. He said Mr Harris was only a bare length to 1.25 lengths clear of BLANCO BAY when he commenced the shift and BLANCO BAY was only ¾ length clear of OSTRAVA.
Mr Harris stated that he put himself into a bad spot, shifted in a little and in turn had put Miss Spratt in a bad spot.
Submissions for Penalty:
Mr Williamson produced Mr Harris' record which showed 1 previous breach of the rule on the 10/11/2017 which was a 4 day suspension for a low range charge.
Mr Williamson said Mr Harris became awkwardly placed and then made an error of judgement when shifting in and placing Miss Spratt in difficulty. Mr Williamson submitted that the level of carelessness for this offence was at the low – mid range, with the shift being low, but the consequences being in the mid range.
Mr Harris submitted that he had a pretty good record and he agreed with the assessment of carelessness being in the low to mid range.
After some discussion regarding riding commitments in the upcoming week Mr Harris advised that he wished to commence his suspension immediately as he had no firm engagements in the next 7 days.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented.
When reviewing the video footage the Committee observed that Mr Harris looked inside prior to commencing to shift ground. Mr Harris was only ¾ length clear of BLANCO BAY who was checked and then tightened OSTRAVA who had to be restrained and lost ground.
The Committee assessed the level of carelessness to be at the low – mid range and adopted 7 national riding days as the appropriate starting point.
The mitigating factors where Mr Harris' admission of the breach and good record. For these combined factors the Committee afforded Mr Harris a 1 day reduction.
After taking into account all factors the Committee considered that a 6 day suspension was appropriate.
