Facts:

Following the running of R 1 the Fat Sally’s Pub & Restaurant Trot Stewards charged Mr L Dobbs (KEN’S DREAM) with a breach of excessive use of the whip alleging that “Mr Dobbs used his whip on more occasions than permitted under Clause b of the Whip Regulations.”

Rule 869 (2) reads:

No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.

Whip Regulation (b) reads:

No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400m. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.

Mr Dobbs admitted the breach but, elected to not attend the hearing.

Mrs Tibbs, with the aid of the video pointed out the position of KEN’S DREAM as the field entered the home straight with KEN’S DREAM behind the leaders on the pole line. Mr Renault stated that Mr Dobbs was seen to use his whip 12 times over the final 200m. He said some of the strikes were just flicks with the rein in hand. He said the use of the whip was low range.

Mr Renault said Mr Dobbs was in his first season of driving and had 19 drives this season. It was his first breach of any rule and he had admitted the breach. He said the penalty guide for a first offence at the low end of the scale was $200. He said Mr Dobbs was aware of the scale and the fine being sought by the Stewards.

Mr Dobbs admitted the charge and has an excellent record. The penalty for a first offence under this Rule is appropriate.
