As Mr Pinn admitted the breach we found the charge proved.

Penalty:

Mr Pinn is suspended from the close of racing on Saturday August 11th up to and including racing on Thursday August 23rd.

(Sunday August 12th was not included in penalty due to riders already being declared).
 

Facts:

Following the running of Race 1(LOWE SCHOLLUM & JONES 2100), an Information was lodged by Mr Oatham stating that Mr Pinn permitted his mount OUR MATRIARCH to shift inwards when not sufficiently clear of GRAND REX which had to be restrained going back onto RED AURORA which was checked near the 1900 metres.

Mr Austin outlined the incident using the videos. Approximately 100m after the start Mr Pinn, who was heading towards the lead, shifted inwards when insufficiently clear of GRAND REX which had to steady. As a result, GRAND REX dropped back into the path of RED AURORA which had to be firmly restrained to avoid the heels of that horse. Mr Austin said Mr Pinn was only one length clear when he crossed.

Both Mr Sharrock and Mr Pinn agreed with the events as described by the Stewards and had nothing further to add.

Submissions for Penalty:

Mr Oatham said this was Mr Pinn’s first charge of careless riding. He had only been riding a relatively short time and was a popular apprentice. Mr Oatham said Ms MacNab was happy to let Mr Pinn go forward and have the lead but problems arose when Mr Pinn restrained his horse as he was moving inwards. In addition, RED AURORA may have been over-racing at the time of the incident, but it did end up in a very awkward position. The Stewards' assessment of the incident was that it was low-mid range carelessness and was more of a misjudgement and inexperience on behalf of Mr Pinn.

Mr Sharrock said Mr Pinn thought he was clear when he began to move across but made an error in judgement by easing up slightly as he did so.

Reasons for Penalty:

The Committee considered all of the submissions presented. Mr Pinn clearly caused interference as he moved inwards when only one length clear of GRAND REX (Sarah MacNab) with the runner in behind (RED AURORA) losing several lengths. We note that Mr Pinn did try to straighten his horse up which was fortunate, or the interference would have been much worse.

In our opinion the incident sat just above the low range therefore we adopted a starting point of 7 days. Mitigating factors were Mr Pinn’s admission of the breach, his good record and his inexperience as a relatively new apprentice rider. Mr Sharrock advised that Mr Pinn had riding commitments through until Saturday August 11th only.

Taking into account all submissions it was the Committee’s opinion that a five day suspension was an appropriate penalty.
