Facts:
Following the running of Race 7, the “HSW Ltd Accountants – Promed Edgeware Doctors – The Haymakers Syndicate Pace, an Information Instigating a Protest was filed by Stipendiary Steward Mr S. W Wallis alleging interference by “Morven Lad” (10), which finished 1st in the race, to “Hey Knowitall” (9), which was pulled up.
The Judge’s placings in this race were as follows:

2nd – Augustus Time (9)
3rd – Billythehuntedone (10)
4th – Lindennys Buttercup (15)
5th – Panic Slowly (1)
6th – Midnight Mayhem (12)
The Information reads as follows:
“I the above named informant allege that horse number (10) or its driver placed 1st by the Judge interfered with the chances of horse number (9) unplaced by the Judge – Interference at the start when MORVEN LAD moved inwards checking Hey Knowitall.”
Rule 869(8) provides as follows:
“The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:
(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, -
immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.”
The connections of “Morven Lad” were represented at this hearing by Mr C. D. Thornley, the driver of that horse. The owner of “Morven Lad”, Mr M. R. Allnut, also attended the hearing. Mr G. D. O’Reilly, the driver of “Hey Knowitall”, represented the interest of that horse.
Submissions for Decision:
Mr Wallis gave evidence and used video coverage to show that “Hey Knowitall” had drawn second from the outside on the front row, and “Morven Lad” had drawn the outside. This was a 2600 metre standing start race. When the tapes were released “Morven Lad” moved inwards sharply making contact with “Hey Knowitall” and dislodging driver Mr G. D. O’Reilly from the sulky. As a consequence “Hey Knowitall” was eliminated from the race. “Morven Lad went on to win the race.
Mr Thornley gave evidence that “Morven Lad” took fright at the sound of the starting tape hitting the outside fence. After some discussions Mr Allnut and Mr Thornley did not contest this protest.
Reasons for Decision:
Accordingly the protest was upheld.
