Facts:
Following the running of Race 10, IRT. #1 Airfreight Company for Standardbreds Mobile Pace, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Junior Driver, Miss A J Cameron, alleging that Miss Cameron, as the driver of BONNY’S GEM in the race, “used her whip on more occasions than is permitted [by Clause (b) of the Use of the Whip Regulation] inside the final 400 metres”.
Miss Cameron had signed the Statement by the Respondent on the information form indicating that she admitted the breach. She was present at the hearing of the information and she confirmed that she admitted the breach. She was assisted at the hearing by Licensed Open Driver, Mr B M Williamson.
Rule 869 provides as follows:
(2) No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.
The Use of Whip Regulations (effective from 30 November 2017) provide:
(b) No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.
Mr Renault showed a video replay of the final 400 metres of the race. He pointed out BONNY’S GEM, driven by Miss Cameron, improving 4-wide as the field neared the home turn and running on in the home straight, being the widest runner. Mr Renault alleged that Miss Cameron had used her whip 14 times inside the final 400 metres of the race. He demonstrated this on the video replay. Miss Cameron and Mr Williamson agreed with the count of 14.
Mr Williamson said that Miss Cameron had been running on from towards the rear. She had been urging her horse and got a little excited, he said. She had gone over the permitted number and had not broken up her whip use, as she needed to do. She had admitted the breach, he said.
Submissions for Penalty:
Mr Renault told the Committee that Miss Cameron has had 5 drives this season prior to today’s race and, last season, had 58 drives. Her record is clear, Mr Renault said.
Mr Renault referred to the penalty guide in the regulation and the penalty of a $300 fine for a breach involving a number of strikes in the range of 14-16. Stewards were seeking a fine of that amount, he said.
Reasons for Penalty:
The Use of the Whip Regulation prescribes a fine of $300 for a breach involving a number of strikes in the range of 14-16. The agreed number of strikes in the present case is 14. The Committee also agreed with that number.
The Committee noted that BONNY’S GEM finished in second placing, the margin from the winner being a head. The Committee has not taken that as an aggravating factor in this instance, having regard to Miss Cameron’s relative inexperience and her Junior Driver status. Her record is clear and she has freely admitted the breach.
A fine in terms of the regulation is appropriate.
