Facts:

After the running of race 3 at Woodville, THE MEAT COMPANY DANNEVIRKE 1600, Casey Mae Waddell admitted a breach of rule 638(1)(d) in that she angled her mount MIZ OLDFIELDS ROAD inward shortly after the start when not clear of WALNUT (Hayden Tinsley) who had to check his mount.

Rule 638(1) (d) reads: A rider shall not ride a horse in a manner the judicial committee considers to be careless.

Miss Waddell represented by Mrs Haigh both acknowledged that they understood they rule and it was the first time in the steward's room for both of them. Trainer Mr G Haigh arrived during the hearing. The process of the hearing was explained to them.

Mr Goodwin, using the films available showed the incident. Soon after leaving the gates Miss Waddell angled her mount inwards when not the required distance clear causing Mr Tinsley to take hold of his mount and be restrained. It was, Mr Goodwin said, Mr Tinsley's intention to ride his mount forward but this was not able to be done because of Miss Waddell's actions.

Miss Waddell and Mrs Haigh had no comment.

Submissions for Penalty:

Mr Goodwin reiterated that it was Miss Waddell's first breach of the rule and that she has had thirteen raceday rides. He asked for a period of suspension. Mr Tinsley's mount was hampered and his stated intention of riding forward could not be carried out. He informed the committee that Miss Waddell was a CD rider only and that he believed any suspension should begin after apprentice day at New Plymouth on 27 October as riding there would be of benefit to her.

Miss Waddell, after having the deferment rule explained to her asked for any suspension to begin after the 27 October.

Reasons for Penalty:

The committee in coming to its decision to impose a four-day term of suspension took into account the breach admittance and that it was the first time she had been charged. However, we expressed concern on the sudden inward movement onto Mr Tinsley's mount causing him to take hold and settle towards the back of the field. We agreed that the period of suspension imposed should begin after Thursday 27 October.
