Decision:

Because Mr Oakden was neglectful in the preparation of his saddle, we find the charge proved.

Penalty:

Accordingly, we impose a $250 fine.

Charge:

Following race 3, an information was filed pursuant to Rule 614(2). The informant, Mr Williamson, alleged that Mr Oakden was neglectful in the saddling of his saddle for use on ABOYNAMEDSUE.

Facts:

Mr George, acting on behalf of Mr Williamson, informed the committee that prior to race 3 Mr Oakden was responsible in preparing the saddling of his saddle for use on ABOYNAMEDSUE. He said Mr Oakden was neglectful in not putting the stirrup irons through the tree of the saddle. Mr George produced the saddle as an exhibit, he showed the committee that the strap above the tree had broken which resulted in both stirrup irons being detached. Mr Coles, Stipendiary Steward, found the stirrup irons from Mr Oakden's saddle still done up on the racecourse. Mr Oakden was forced to pull up ABOYNAMEDSUE from the race with the aid of the clerk of course.

Mr Oakden told the committee he thought he had prepared his saddle correctly.

Reasons for Decision:

The committee carefully considered all the evidence presented. Having inspected the saddle it is clear that Mr Oakden was neglectful in his preparation of the saddle. The key factors that supported this were, the broken strap above the tree, the fact the stirrup irons were found on the racecourse still done up and the tree part of the saddle was not damaged.

Submissions for Penalty:

Mr George said Mr Oakden's had a clear record under this rule. However, he told the committee that the punters and connections of ABOYNAMEDSUE were disadvantaged by Mr Oakden's actions. He advised the committee that it was also a safety issue and Mr Oakden needed to be mindful of this when preparing his saddle. Mr George submitted a fine of not less than $200.

Mr Oakden when asked for submissions on penalty had nothing to say.

Reasons for Penalty:

The committee carefully considered all the evidence and submissions presented. The mitigating factor is Mr Oakden's clear record under this rule. However, clearly the punters and connections were let down by Mr Oakden's negligence. We note that Mr Oakden was fortunate he did not injure himself in the incident which required him to retire his mount from the race. The committee referred to the JCA penalty sheet, this showed there had been no breach of this rule in the last year. Balancing all of these facts we assess an appropriate penalty to be a $250 fine.
