Facts:

Stewards charged Mr K Tyler with a breach of rule 652 (2) in that as the trainer of HAYLE MAREE in race 1 “… he failed to notify Stipendiary Stewards that the mare was in foal.”

Rule 652 (2) reads:

A trainer who has completed a form under Rule 326 (1) in respect of a filly or mare which is being served by a stallion in breeding season must notify a Stipendiary Steward.

Rule 326 (1) reads:

Within seven days after any horse is taken or comes into the charge of a Trainer for the purpose of being trained the Trainer shall complete a forward to NZTR the form prescribed for that purpose by NZTR and in completing that form the Trainer must ensure that he has correctly identified the horse.

Mr Tyler admitted the breach but did not appear at the hearing.

Mr Davidson stated the Stewards became aware the mare was in foal post-race. He said Mr Tyler had an obligation under the rules to fill out the correct forms and notify NZTR.

Mr Tyler, when spoken too by Stewards, said he was unaware of the rule.

Submissions for Penalty:

Mr Davidson submitted that a mare in foal won a GI race in 2014, the trainer was fined was $500. Just recently a trainer was fined $100 for failing to notify a mare had been served. He sought a fine of $200 in this instance.

Mr Tyler accepted a fine would be imposed.

Reasons for Penalty:

Mr Tyler admitted the breach at the first opportunity. The breach is not at the high end or the low end.
