As Mr Johnson had admitted this breach of the Rules it was found to be proved.

Penalty:

We therefore determined that Mr Johnson’s Jockey's licence be suspended from the conclusion of racing on 8 August 2015 up to and including 20 August 2015. This suspension encompasses the days racing at Oamaru on 13 August, Otaki on 15 August, Wanganui 16 August and Woodville on 20 August 2015.

Facts:

Following the running of Race 9, the Hoteliers Challenge Cup Maiden, an Information was filed by Co-Chief Stipendiary Steward, Mr N McIntyre, against Class A Rider, Mr C Johnson, the rider of LOCATION, alleging careless riding over the concluding stages, in that Mr Johnson allowed his mount to shift outwards causing a check to MASTERZED, ridden by Miss K Myers.

Rule 638(1)(d) reads as follows:

“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:

(d) careless”

Mr Johnson had indicated on the Information that this breach of the Rules was admitted and he confirmed this at the hearing. Mr Johnson also agreed that he understood the charge and the Rule it was brought under.

Mr McIntyre gave evidence and used video coverage to show that after entering the final straight, LOCATION, ridden by Mr Johnson, was in the trail and eventually gained a run close to the rail near the 200m on the inside of MASTERZED, ridden by Miss K Myers. Mr McIntyre said that Mr Johnson, when improving past MASTERZED, began to shift outwards near the 100m and continued on in an outward movement until MASTERZED ran out of room just shy of the winning post and had to check. Mr McIntyre estimated that Miss Myers had to check approximately 2 strides off the post and in his opinion, had cost MASTERZED 3rd placing.

Mr Johnson stated he realised his horse was shifting ground outwards away from the whip and he stopped riding his horse out when he got a call from Miss Myers. He said after viewing the video replays he realised that he was a stride or two too late in straightening his mount.

Submissions for Penalty:

Mr McIntyre submitted that Mr Johnson had admitted the breach at the first opportunity with his penalty record showing a suspension of 4 days at the Otaki meeting on 21 February 2015. He said that Mr Johnson had ridden in excess of 200 occasions since that suspension. He submitted that the level of carelessness was mid-range with the consequences of that carelessness being that a horse had been denied a higher placing. Mr McIntyre stated that Mr Johnson was considered a Central Districts and South Island rider with the JCA Penalty Guide recommending a starting point of a 5 day suspension for a breach of this rule. He submitted that after taking all matters into consideration a 4 day suspension be considered as penalty in this case.

Mr Johnson confirmed with the Committee that as the fields were out for the final days racing at Christchurch and that any suspension would begin at the conclusion of that meeting on Saturday.

The issue of deferment was discussed but found to be not relevant as there were no Central Districts or South Island race dates applicable.

Mr Johnson made no further submissions on penalty.

Reasons for Penalty:

In determining penalty the Committee took into consideration Mr Johnson’s ready admission of the breach, the level of carelessness, to which we agreed with the Stewards as being mid-range, and the consequences of his carelessness. We also took into account the fact that the previous suspension was nearly 6 months previous and considering that he had ridden in excess of 200 occasions since, we determined that his record could be considered as reasonably good. In taking the JCA Penalty Guide starting point of 5 days we were able to give Mr Johnson a discount of 1 day for his admission of the breach and reasonably good record. We therefore determined that a 4 day suspension was an appropriate penalty in this case.
