The charge is admitted and is therefore upheld.

Penalty:

The Committee orders that Mr Coleman's licence be suspended from the conclusion of racing on the 17th of December 2017 until after the conclusion of racing on the 23rd of December 2017 (5 National Riding Days).

Facts:

Following the running of the DUNSTAN FEEDS 1500 CHAMPIONSHIP QUALIFIER an Information was lodged by Senior Stipendiary Steward Mr M Williamson against Class A Rider Mr M Coleman alleging that Mr Coleman permitted his mount DASHPER to shift inwards when not sufficiently clear of INDECISION which was forced inwards onto MORRIE OCK which was checked near the 1100 metres.

Rule 638(1)(d) provides : a Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Coleman was present and he acknowledged that he understood the Rule and that he admitted the breach.

Chief Stipendiary Steward Mr J Oatham demonstrated the incident using the race films. He showed where towards the end of the back straight DASHPER was racing in a 3 wide position and Mr Coleman shifted his mount inwards putting pressure on INDECISION which then is forced onto and checks MORRIE OCK.

Mr Oatham said that Mr Coleman was not the required distance clear when he moved his horse inwards.

Mr Coleman said that after looking at the films it was clear that he was not the required distance clear. He said that his horse was green and it buttoned off on the turn and lay in on top of the other horses. 

Submissions for Penalty:

Mr Williamson said that Mr Coleman had 2 previous breaches of this Rule in the last 12 months. On the 1st of January 2017 he was suspended for 4 days and on the 29th of November 2017 he also received a suspension of 4 days.

He said that Mr Coleman's horse did button off and that this incident was in the low range of seriousness.

Mr Coleman said that he considered the incident low range and he said his record was quite good. He asked that those matters be taken into account.

Mr Coleman requested a deferment of suspension until after racing at Ellerslie  on the 17th of December because he has declared rides at that meeting.

Reasons for Penalty:

The Committee viewed the films several times and noted that Mr Coleman was only a bare length clear when he started to shift inwards and as a result of his shift both riders of the affected horses had to take hold of their mounts with MORRIE OCK losing one and a half to two lengths.

The Committee takes the view that this is a low range incident and for that a starting point penalty of 6 National days applies. We give Mr Coleman credit for his admission of the breach and his record.

We also grant a deferment of the suspension pursuant to Rule 1106(2).
