Penalty:
From a starting point of 5 days and taking all the above factors into account we impose a suspension on Mr Bosson from riding in races which is to start after racing on 15 February and conclude after racing on 24 February 2014 (5 North Island days).
Facts:
Following race 8, the Caci Pukekohe/Diosa Hair 1600, an information was filed pursuant to rule 638 (1) (d). The informant Mr Williamson alleged that near the 1500 metres CARINATA (O Bosson) shifted in dictating NEK MINNIT (Miss B Grylls) in on to SO HIGH (Miss S Spratt) which was forced into the line of ZAVAMAR (M Cameron) which clipped a heel and blundered.
Rule 638 (1) (d) provides: a rider shall not ride a horse in a manner which the Judicial committee considers to be careless.
Mr Coles demonstrated the video films pointing out CARINATA racing in a midfield position approaching g the 1500 metres. Racing on her inside was NEK MINNIT and on his inside was SO HIGH. ZAVAMAR was inside those runners but further back. Mr Coles then showed the committee Mr Bosson angling his mount inwards and in doing so made contact with NEK MINNIT which was shifted in abruptly onto SO HIGH. This movement resulted in SO HIGH being forced into the line of ZAVAMAR causing him to clip a heel and blunder. Mr Coles concluded by saying that Mr Bosson did correct immediately when he realised the impact his inward movement was having on the horses above. However this was after the incident had occurred.
Mr Bosson, in admitting the breach, conceded he had come across too sharply but his horse was green and all the horses on his inside were kicking up at the time.
Mr Williamson, in summing up, said it was clear that Mr Bosson had come across too sharply but it was made to look worse because the inside horses were all kicking up.
Submissions for Penalty:
Mr Williamson said there were some mitigating factors surrounding the charge, namely the movement from the runners on the inside of Mr Bosson. He stated they were green horses with SO HIGH and ZAVAMAR in particular, both trying to kick up and maintain their line. Mr Williamson said the stewards could understand Mr Bosson not realising they were there. However he concluded by saying Mr Bosson had not left sufficient room and it is never a good look when a horse clips a heel and blunders. He submitted, however, in the opinion of the stewards, the breach was at the low end. Mr Williamson produced Mr Bosson's record which showed 4 suspensions in the last 12 months.
Mr Bosson confirmed to the committee when asked that he was currently only riding in the North Island. He said he had commitments until after the Ellerslie meeting on 15 February.
Reasons for Penalty:
The committee carefully considered all evidence and submissions before imposing an appropriate penalty. Mitigating factors are Mr Bosson's admission of the breach and it was evident the horses on his inside were kicking up in the early stages of the race. However in aggravation, Mr Bosson clearly angled in when not the required distance clear of NEK MINNIT which resulted in ZAVAMAR clipping a heel. The committee finds the breach to be in the low to mid range. We also considered Mr Bosson's record which we define as average.
