As Mr Campbell has admitted the breach, we find the breach proved.

Penalty:

Mr Campbell’s licence is suspended from 4 January 2019 up to and including 11 January 2019 (5 days).

Facts:

Mr Davidson alleged that Mr Campbell used his whip excessively on his mount FOX IN SOCKS prior to the 100 metres in race 3, the NZB INSURANCE PEARL SERIES RACE 1250.

Rule 638(3)(b)(ii) provides: “A Rider shall not strike a horse with a whip in a manner or to an extent, which is excessive.”

Mr Davidson had Mr McLaughlin demonstrate the breach using the videos. He pointed out there were eight strikes before the 100 metres. There was no clear break for five strides. There was one pause.

Mr Walsh said Mr Campbell got there a bit quicker than he thought and that Waikouaiti was a long straight. There had been one pause, but it was not long enough.
Mr Campbell said he had been very busy lately and had had a brain fade in the heat of the finish.

Submissions for Penalty:

Mr Davidson produced the respondent’s record, which evidenced two previous breaches of this rule. He said the starting point was 6 to 8 days’ suspension. He believed this particular breach was low end.

Mr Walsh and Mr Campbell accepted Mr Davidson’s submission. Mr Walsh emphasised that Mr Campbell was a busy and an extremely promising apprentice and that until today it was evident that he had learned from his two previous breaches at the Riverton Easter carnival.

Reasons for Penalty:

This is the respondent’s third breach of this rule over the past 12 months. The starting point for a third or subsequent breach of r 638(3)(b)(ii) is 6-8 national riding days suspension.

The breach is low range. There are eight strikes with a clear break but not for five strides. The starting point in the Penalty Guide is a 6 to 8 national riding days. We take a 6 day starting point and reduce this by one day as it is eight months since Mr Campbell last breached this rule. This is to his credit, as he is a very busy apprentice and has had a considerable number of rides in this time.
