Decision:

The protest was upheld and LITTLE MO was disqualified from the race. Consequent upon the relegation, the amended result of the race is as follows:

1st  15 Enthral
2nd   2 Need Success
3rd  10 Sunbloc
4th    9 Snow Boy
5th  11 Contella

It was ordered that dividends and stakes be paid in accordance with that amended result. 

Facts:

Following the running of Race 2, Breckon Farms Trot, an information instigating a protest was filed by Co-Chief Stipendiary Steward, Mr N G McIntyre, against LITTLE MO (C B Ford), placed 4th by the judge, on the grounds that it “switched to a pace after approximately 300 metres and failed to promptly regain its proper gait”.

Mr Ford was present at the hearing of the information and he indicated that he represented the connections of LITTLE MO.

Rule 870 provides as follows:

(3) Any horse which breaks from its gait shall promptly regain its proper gait.

(4) Any horse which breaks from its gait in any race and:-

(a) which fails to promptly regain its proper gait . . . may (in addition to any penalty imposed pursuant to Rule 1003 hereof) subject to the provisions of the Breaking Horses Regulations made by the Executive, be placed by the Judicial Committee immediately after any other horse in respect of which any advantage may have been gained.

The Breaking Horses Regulation provides as follows:

For the avoidance of doubt and in order to clarify the situation for all parties concerned, the following shall apply with regard to breaking horses:

(a) Any horse which breaks from its gait either at the start or during the running of any race and continues on in the break for a distance of 150 metres or greater, shall be deemed to be in breach of Rule 870 (3) in that it has failed to promptly regain its proper gait.

Where a protest has been duly lodged against the placing of an offending horse, the Judicial Committee shall either:

(i) relegate such horse under Rule 870 (4) to behind any other horse in respect of which an advantage may have been gained; or

(ii) disqualify it from the race under Rule 1003 (2).

Submissions for Decision:

Mr McIntyre showed a video replay of the race. He pointed out LITTLE MO, driven by Mr Ford, trailing the leader, SUNBLOC (M P Jones), approximately 300 metres after the start of the 2600 metres standing start event for C0 trotters. As the field approached the 2300 metres, he pointed out LITTLE MO go into a break and be taken clear of the field by Mr Ford.

Mr McIntyre said that the horse came down in a pace at the back of the field and continued in a pace. Mr Ford had informed the Stewards that he had only realised with approximately 400 metres to run that the horse had been pacing, at which point he broke the horse up to get it back into a trot. Mr McIntyre alleged that LITTLE MO had been in a pace for approximately 1700 metres. The horse recovered from its break at the 400 metres and ran on to finish in 4th placing.

Mr Ford did not contest the disqualification of LITTLE MO.

Reasons for Decision:

The Committee was satisfied that LITTLE MO had broken from its gait and had continued in a pace for approximately 1700 metres, from approximately the 2100 metres to the 400 metres. This was clear from the video evidence and was not disputed by Mr Ford. This was a very clear breach of the Breaking Horses Regulation and also a breach of Rule 870 (3) and (4) (a) in that LITTLE MO had failed to promptly regain its proper gait. It was appropriate to disqualify LITTLE MO from the race.
