In these circumstances we relegate BELLE DELIGHT to behind STRATEGIC MISS.

Amended placings are:

1st  11  LUCKY GETAWAY
2nd  6  REAL FAITH
3RD  9  ROXY ROX
4TH      VILLAGE CLUB

Dividends and stakes are to be paid accordingly.

Facts:

Mr Renault alleged that horse number 11, LUCKY GETAWAY that was placed 1st by the Judge in race 2 and horse number 8, BELLE DELIGHT that was placed 3rd by the Judge interfered with the chances of horse number 13, STRATEGIC MISS, which was pulled up and thus finished last. This interference was alleged to have occurred in the run home.

Judge’s placings were:

1st  11  LUCKY GETAWAY
2nd   6  REAL FAITH
3RD   8  BELLE DELIGHT
4TH   9  ROXY ROX
5TH       VILLAGE CLUB

The inquiry commenced with less than 3 minutes to the start time of the next race. The drivers indicated that they represented the connections of their various horses.

Submissions for Decision:

Mr Renault demonstrated on the videos that in the home straight STRATEGIC MISS was making a run to the outside of BELLE DELIGHT and to the inside of LUCKY GETAWAY when the horse ran out of room and broke, losing its chance. He stated that LUCKY GETAWAY was hanging and that BELLE DELIGHT had shifted ground outwards.

Mr Renault called upon Mr Shirley, the driver of STRATEGIC MISS, to give evidence. He stated that he had received pressure from his outside and he clipped the cart of the horse on his inner. He stated that he did not believe there was pressure from his inside.

Mr Armour, the driver of BELLE DELIGHT stated there had been general tightening and that he believed he had run in a straight line.

Mr Williamson, the driver of LUCKY GETAWAY stated there was always a gap between his horse and that of Mr Shirley. He thus did not believe he had caused any interference.

Reasons for Decision:

We agree that LUCKY GETAWAY was hanging immediately prior to the incident but we note that Mr Williamson had taken corrective action on 2 occasions. At no time was there contact between LUCKY GETAWAY and STRATEGIC MISS and we do not believe Mr Shirley had to shift inwards on the track as a consequence of LUCKY GETAWAY hanging. Rather it is our view once in the gap between LUCKY GETAWAY and BELLE DELIGHT, STRATEGIC MISS ran straight. The principal reason for the interference to STRATEGIC MISS in our view is that BELLE DELIGHT ran out half to three-quarters of a cart width and, in so doing, crowded STRATEGIC MISS, which broke after contact with the cart of BELLE DELIGHT. There was no outwards movement from the horses to the inside of BELLE DELIGHT that contributed to the incident.

In exercising our discretion and dismissing the protest against the winner and upholding the one against third, we are satisfied that STRATEGIC MISS suffered interference as a consequence of outwards movement from BELLE DELIGHT at a crucial stage of the race (the run home). Furthermore STRATEGIC MISS was finishing strongly and had made significant ground on BELLE DELIGHT immediately prior to the interference.
