Charge:
After the conclusion of race 2 the Otago Architectural Painters Mobile Pace an information was lodged by Stipendiary Steward Mr N. G. McIntyre under rule 869(2)(a) alleging that horseman B. O’Connor used his whip unnecessarily when driving Big Rocket in the run home.
The rule reads:
No horseman shall during any race use his whip in an unnecessary, excessive or improper manner.
Facts:
Mr McIntyre stated that a horseman has an obligation to try his horse if there is a reasonable chance of his horse finishing in the first six placings.
In Mr O’Connor’s case his horse Big Rocket had dropped off the body of the field entering the front straight for the final time and in the Stewards opinion was not going to finish any closer.
Mr O’Connor was observed to strike his horse on three or four occasions which was considered to be unnecessary.
The committee also viewed several video clips of the alleged incident.
Submissions for Penalty:
Mr McIntyre stated Mr O’Connor had no previous charges under this rule from twenty race day drives this season.
The breach was considered to be mid to low range.
Mr O’Connor made comment to the effect that the rule appears to be being applied inconsistently throughout the country.
Reasons for Penalty:
It was clear from the video evidence that on this occasion Mr O’Connor has made a simple error of judgment striking his horse Big Rocket at least three times in the home straight when the horse had quite clearly not responded much earlier in the race to his urgings.
Mr O’Connor was given credit for his admittance of the breach and his clear record under this rule the committee also considered the recent decision of Mr M at Forbury Park where a fine of $150 was imposed under this rule for a breach under similar circumstances.
