Facts:
This charge arises from race 8, Matamata Veterinary Services Kaimai Stakes (Listed Race.) An Information was filed pursuant to Rule 330 (3) (c). The Informant, Mr Jones, alleged that Mr Elliot failed to make the weight for INSCRIPTION.
Mr Elliot said that he understood the Rule and confirmed he admitted the breach.
Rule 330(3)(c) provides: “A rider shall not fail to ride a horse at the weight at which it is handicapped to carry”.
Mr Jones advised that Mr Elliot failed to make the contracted weight of 53 kgs on INSCRIPTION. He said the best that Mr Elliot could do was 54.5 kgs, accordingly he was 1.5 kg over the carded weight.
Mr Elliot said that he has had a busy week and his partner has been unwell. As a consequence, he was unable to get his weight down to 53 kgs.

Mr Jones said that although this is Mr Elliot’s 2nd breach within the last 120 days his overall record is poor having breached this Rule 5 times within the previous 12 months.
Mr Jones said that Stewards were compelled to file an Information on this occasion given Mr Elliot’s poor record and the status of the race. He added Mr McCarroll, the Trainer, of INSCRIPTION was inconvenienced by having to find a suitable lightweight rider. He submitted that a monetary penalty would be appropriate with an uplift from the normal $200 fine.
Mr Elliot had nothing to say on penalty.

The Committee considered all the evidence and submissions presented.
Ordinarily a 2nd breach would be dealt with by way of a Minor Infringement notice resulting in a $200 fine.
In determination of penalty the Committee took into account that this is Mr Elliot’s 2nd breach within the reset period of 120 days and that he was 1.5 kg over the carded weight. Also, the betting public's expectation that Mr Elliot would fulfil his engagement. The clear aggravating factors were that the breach occurred in a Listed race with stakes payable of $50,000 and that the connections had to find a suitable replacement rider at short notice.
