Facts:
An Information Instigating a Protest was lodged by Stipendiary Steward Mr JM Muirhead against the 3rd placing of THE REID RUNNER on the grounds of interference racing into the first bend when, THE REID RUNNER moved outwards onto PERUVIAN VANCE and as a result caused a severe check to HOLME FROM THE SEA.
Mr Reid was present and as Trainer/Driver and part Owner represented the connections of his horse.
Mr MW McKendry was present and advised that he represented the connections of HOLME FROM THE SEA.
Mr SL Hunt was present as Trainer/Driver of PERUVIAN VANCE and he represented the connections of his horse.
Mr Reid advised the Committee that the Protest was contested.
Mr Muirhead demonstrated the incident by use of the video films. He said that THE REID RUNNER had come out and there was contact with the front legs of PERUVIAN VANCE causing this horse to run out further and cause a severe check to HOLME FROM THE SEA.
Mr McKendry said there was pressure from the inside and that PERUVIAN VANCE had got it's legs under Mr McKendry's sulky shaft and had caused a check to his horse. Mr McKendry said his chances were affected because he had seen Mr Reid moving out and he thought he had a chance of getting on his back.
Mr Hunt said that when Mr Reid pulled his horse out he had clipped Mr Reid's wheel and had broken. He said that his horse pulls and at the time there had been an easing of the pace. He said his chances were not affected.
Mr Reid said that he was in the process of pulling out and at that stage there were no horses outside him. He said he felt pressure from behind and a horse had hit his wheel. He did say that at the time he was ahead of the horses involved in the Protest.
Submissions for Decision:
Mr Muirhead after listening to the evidence viewed the films again and asked the Committee if he could withdraw the Protest.
Reasons for Decision:
Mr Muirhead has asked to withdraw the Protest.
