Facts:
Following race 7 an information was filed pursuant to rule 330 (3) (b) by the informant Mr A Coles. He alleged that Mr R Eynon permitted himself to be engaged for 2 horses being CAPE KINAVERAL and VOLKSWAGIN.
Submissions for Decision:
Mr Coles stated the committee was well aware of the facts surrounding the charge which was covered and documented in the request for a ruling heard earlier today.
Mr Eynon said it was daunting being involved in this charge concerning these 2 professional trainers.
Submissions for Penalty:
Mr Coles said this was Mr Eynon's first charge under this rule and submitted a fine in the vicinity of $200 would be appropriate.
Mr Eynon had nothing to add.
Reasons for Penalty:
The committee carefully considered all the evidence and submissions as presented. It was explained to Mr Eynon that this charge today was due to his lack of commitment to both trainers regarding his riding engagements in the Great Northern Steeplechase. In addressing penalty the committee has taken into account Mr Eynon's admission of the breach and that this was his first charge under this rule.
