As Mr Ralph admitted the breach the Committee found the charge proved.

Mr Ralph was fined $300.

Facts:

Following the running of race 5, Fortuna – Melody Belle, an Information was filed pursuant to Rule 614(2). The Informant, Mr Oatham, alleged that Mr Ralph omitted a towel when saddling ARMAGUARD whose jockey weighed in 0.8 kg light.

Mr Ralph acknowledged that he understood the Rule and confirmed his admission of the breach.

Rule 614(2) provides: A person must not be neglectful or careless in saddling a horse.

Mr Oatham advised the Committee that Mr Goindasamy, the rider of ARMAGUARD, weighed in 0.8 kg under his weigh out weight. He said Stipendiary Steward, Mr Robinson, found a large towel on the back wall in the tie up stalls and Mr Ralph omitted the gear when saddling his horse. The towel was produced as an exhibit at the hearing.

Mr Oatham said that ARMAGUARD finished in 6th place and submitted the horse should be disqualified from the race. He added that it was fortunate that no bets types were involved given the 6th placing of ARMAGUARD.

Mr Ralph admitted that he left the towel on the back wall when saddling up ARMAGUARD.

Submissions for Penalty:

Mr Oatham said that Mr Ralph had a clear record under this Rule in the last 12 months. He said that the large towel weighed 0.8 kg which was equal to failing to attach a lead bag. He submitted a fine in the vicinity of $300 would be appropriate.

Mr Ralph accepted he was neglectful when saddling up ARMAGUARD. Initially he thought a $300 fine was too harsh but then accepted the consequential effects of his actions.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

Neglect in saddling when there are consequences for the betting public and owners or horse or rider safety issues are apparent has a starting point of a $750 fine. Mr Ralph was fortunate that ARMAGUARD finished in 6th place otherwise the penalty imposed would have been higher.

Omitting a towel when saddling has a new starting point effective 1 August 2018 of a $150 fine previously it was $300.

Historical records show that Mr Ralph has previously omitted a towel and a lead bag therefore he needs to be more vigilant when saddling.

After taking into account the circumstances of this case the Committee considered that a $300 fine was appropriate.
