As Mr O’Reilly had admitted this breach of the Rules it was found to be proved in accordance with Rule 1111(1)(d).

Facts:

Following the running of Race 3, the Electronet Pace, an Information was filed by Stipendiary Steward Mr N. G. McIntyre against Open Horseman Mr L. F. O’Reilly alleging a breach of Rule 869(2)(a) in that he used his whip excessively.

The charge reads as follows.

I the abovenamed informant allege that the abovenamed Defendant committed a breach of Rule 869(2)(a) in that horseman L. O’Reilly used his whip excessively in the run home when driving “Kenmore Star”.

Rule 869(2)(a) reads as follows.

“(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.”

Mr O’Reilly had indicated on the Information that this breach of the Rules was admitted, and also that he did not wish to attend the hearing.

Mr McIntyre gave evidence and used video coverage to show that Mr O’Reilly had used his whip on about 22 occasions in the run home.

In relation to penalty Mr McIntyre advised that Mr O’Reilly had no relevant previous convictions, and as he had admitted the breach it was submitted that a fine of $200-00 should be imposed in this case.
