The Committee accordingly declares SAUCY PENNY to be a non-starter.
Facts:
Following the running of Race 5, the EBONY GROSVE 2100 an Information was lodged by Stipendiary Steward Mr MJ Williamson pursuant to Rule 632. Mr Williamson as the Informant lodged a Request for a Ruling as to whether SAUCY PENNY was denied a fair start due to the barrier being slow to open.
Rule 632 provides:
“If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter.”
Mr Williamson demonstrated the incident by use of the Race Films. These showed that at the start of the Race all gates had opened except for the one for SAUCY PENNY. It subsequently opened but as a result of the delay in opening SAUCY PENNY was slow away and at the rear of the field.
Mr Williamson said that there was no evidence to show that SAUCY PENNY contributed to the failure of the gates to open.
Ms B Grylls, the Rider of SAUCY PENNY told the Committee that she believed that her horse lost 3-4 lengths as a result of the barrier gate being slow to open.
Submissions for Decision:
Mr Williamson submitted that as SAUCY PENNY was delayed at the start through the failure of the gate to open it should be declared a non starter.
Reasons for Decision:
The Committee viewed the films several times. These very clearly show that SAUCY PENNY’S gate was closed when all the others were open and the other horses were moving. We are told that this was due to mechanical failure and clearly this is so.
Ms Grylls has told us that her horse lost 3-4 lengths as a result of the gate not opening and we agree with her assessment.
We are quite satisfied that the failure of the gate to open at the same time as the others materially prejudiced the chances of SAUCY PENNY and it should be declared a non-starter.
