As Mr Thomas admitted the breach, we find the breach proved.

Penalty:

Mr Thomas is fined the sum of $300.

Charge:

Mr Renault, stipendiary steward, alleged that Mr G Thomas drove carelessly causing interference to NOTTINGHAM JJ and SEAVIEW GOLD.

Rule 869(3)(b) states: “No horseman in any race shall drive carelessly.”

Facts:

Mr Renault stated that Mr Thomas driving ASCOT BOY, had moved from a 3 to a 2 wide position at the 800 metres. He said there were 2 horses on the inside of Mr Thomas when he shifted down on the track. He said Mr Thomas was not clear of NOTTINGHAM JJ and SEAVIEW GOLD, which both broke and lost ground.

Mr Thomas said that as we had upheld the protest he did believe there was anything that he could say that would lead us to conclude that his driving was not careless.

Submissions for Penalty:

Mr Renault produced Mr Thomas’s record. This showed he has had 1166 life-time drives; 62 last season and 17 this season. He said the respondent’s record was clear this season. He described the breach as mid-range, emphasising that there had been a relegation as a consequence of the respondent’s actions.

Mr Thomas stated that his record had been clear for at least 2 seasons. 

Reasons for Penalty:

We accept that Mr Renault’s description of the breach as being mid-range is correct. The respondent’s actions led to the relegation of his horse with consequent loss to the connections of ASCOT BOY and those persons that had invested on the horse.

From a starting point of $500, which is recommended in the Penalty Guide as being appropriate for a breach that has resulted in a change of placings, we give a $200 reduction for the respondent’s excellent record and his ready admission of the breach.
