Accordingly, the protest is upheld and the amended placings are now:

1st No. 6 FIFTYSHADESOFGREY
2nd No. 10 RED DAKOTA
3rd No. 4 BIGGIN HILL
4th No. 8 DREAMCOAT

In conclusion we order the payment of stakes and dividends.

Facts:

Following the running of Race 7, Waikato Tractors 1400, an Information was filed Instigating a Protest pursuant to Rule 642(1). The Informant, Mr A Scott, alleged that RED DAKOTA placed 1st by the Judge interfered with the chances of FIFTYSHADESOFGREY placed 2nd by the Judge.

The interference was alleged to have occurred in the final straight.

The Judge's placings were as follows:

1st No. 10 RED DAKOTA
2nd No. 6 FIFTYSHADESOFGREY
3rd No. 4 BIGGIN HILL
4th No. 8 DREAMCOAT

The official margin between 1st and 2nd was a nose.

Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.

All connections present acknowledged they understood the Rule.

Submissions for Decision:

Mr Scott identified on the head on film that at the top of the straight FIFTYSHADESOFGREY was racing approximately 3 lengths behind RED DAKOTA. He said RED DAKOTA shifted outwards near the 300 metres and took the rightful running line of FIFTYSHADESOFGREY. He said in doing so RED DAKOTA severely checked FIFTYSHADESOFGREY who had its momentum stopped. He added FIFTYSHADESOFGREY had to pick herself up off the floor, she dived late at RED DAKOTA and went down by the barest of margins.

Mr Grylls submitted he agreed with Mr Scott’s interpretation of the incident. He said FIFTYSHADESOFGREY was 3 to 4 lengths off RED DAKOTA and making up considerable ground when RED DAKOTA shifted out. Mr Grylls stated he lost momentum and but for the interference FIFTYSHADESOFGREY would have won the race.

Mrs Thornton representing the connections of RED DAKOTA disagreed with the submissions presented by Mr Grylls. She submitted FIFTYSHADESOFGREY was under a hard ride and while she conceded her mount did shift out near the 250 metres Mrs Thornton believed BIGGIN HILL contributed to the interference by shifting in.

Mr Williamson submitted in the Stewards' opinion there was a significant shift outwards by RED DAKOTA which caused most of the interference. He said FIFTYSHADESOFGREY was about 3 lengths behind RED DAKOTA near the 400 metres and had made significant ground to be on that horses heels when it began to shift out near the 250 metres. As a result FIFTYSHADESOFGREY lost between 1 ½ to 2 lengths and made up that ground over the concluding stages to be beaten by a nose. He submitted based on those facts the Stewards would support the protest.

Mr Scott in summing up submitted he agreed with Mr Williamson's assessment of the interference.

Mrs Thornton in summing up submitted in her opinion there had been equal movement from her mount and BIGGIN HILL.

Reasons for Decision:

The Committee carefully considered all of the submissions and reviewed the video films several times. We established that near the 350 metres FIFTYSHADESOFGREY was racing about 3 lengths behind RED DAKOTA. Shortly after that point FIFTYSHADESOFGREY was making up ground strongly and had its rightful running line dictated to when RED DAKOTA shifted out at least 2 horse widths when struck with the whip. In doing so FIFTYSHADESOFGREY had to be checked and lost valuable momentum which caused Mr Grylls to change ground. In our opinion the inward movement of BIGGIN HILL was minimal. It was very clear over the closing stages FIFTYSHADESOFGREY was taking significant ground off RED DAKOTA to get within a nose of that horse at the winning post.

Therefore, we are satisfied that FIFTYSHADESOFGREY would have beaten RED DAKOTA had such interference not occurred.
