As the breach was admitted we find the charge proven.
Penalty:
The committee is satisfied that Miss Collett has been riding throughout the country on industry days. We have adopted 5 days as the starting point for an appropriate penalty. After taking all the above factors into account we have given Miss Collett a concession in consideration of the mitigating elements. Therefore the committee determines a four day suspension is fitting for this charge.
Accordingly, and under the provisions of rule 1106 (2), we suspend Miss Collett from riding in races, such suspensions to start after racing on 14 November and conclude after racing on 20 November 2015 (4 riding days).
Facts:
Following Race 5, The Risk Management Group 1400, an information was filed pursuant to Rule 638(1) (d). The informant alleged that Miss S Collett permitted her mount MASSOFDASH to shift inwards when not sufficiently clear of LIGHT SHADOW which was checked inside the final 50 metres with CUSTER then having to be checked to avoid the heels of LIGHT SHADOW.
Rule 638(1)(d) reads; A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Coles demonstrated the incident using the video films and pointing out MASSOFDASH racing in a 4 wide position in the final 50 metres. On her inside was LIGHT SHADOW ( C Lammas) and behind that pair on the rail was CUSTER ( T Thornton). Mr Coles said Miss Collett, whose mount was travelling very well, allowed her mount to move in and take the line of LIGHT SHADOW when only a bare length clear. He said this caused Mr Lammas to check his mount which resulted in him being shuffled back on to CUSTER which was also checked. Mr Coles conceded that Miss Collett did stop riding and staighten but it was 2 strides too late.
Miss Collett in admitting the breach said the films showed that she had crowded the 2 runners on her inside. However she said she was level pegging with Mr Lammas whose mount was under pressure, and her mount tended to follow him in. She said she had momentum up and was trying to win the race but conceded she was 2 strides too late to straighten.
Submissions for Penalty:
Mr Oatham said that Miss Collett had only incurred 2 suspensions in the last 12 months and they were both last January so he submitted her record was a good one. He said today's breach was at the lower end of the scale although Miss Collett should have straightened earlier than she did. Mr Oatham said there were no consequences as a result of Miss Collett moving in as both horses affected held their places. He submitted any penalty should be at the bottom end.
Miss Collett said she had commitments up to and including 14 November and she rode throughout New Zealand having ridden at Timaru on a Friday last month.
