As Mr Butt had admitted this breach of the Rules it was found to be proved in accordance with Rule 1111(1)(d).

Penalty:

Accordingly Mr Butt was fined the sum of $200.00.

Facts:

Following the running of Race 2, the Studholme “Premier Yearlings” F&M Mobile Pace, an Information was filed by Stipendiary Steward Mr N. M. Ydgren against Junior Horseman Mr R. J. Butt alleging a breach of Rule 869(4) in that he drove in a manner likely to cause interference.
 
The charge reads as follows.
 
I the above named informant allege that the above named Defendant committed a breach of Rule 869(4) in that shortly after the start Mr Butt allowed his horse to shift  down the track causing interference to Devoy (A. Hastie) and secondary interference to Invisible Tonight (M. Purdon) and The Slipper (S. Thompson).”
 
Rules 869(4) reads as follows,
 
“(4) No horseman shall during any race do anything which interferes or is likely to interfere with his own horse and/or any other horse or its progress.”
 
Mr Butt had indicated on the Information that this breach of the Rules was admitted, and also that he did not wish to attend the hearing.

 

Submissions for Decision:

Mr Ydgren gave evidence and used video coverage to illustrate this incident as set out in the Information.

Submissions for Penalty:

In relation to penalty Mr Ydgren advised that Mr Butt had no previous relevant convictions and that the breach was at the lower end of the scale. As the breach had been admitted Mr Ydgren submitted that a fine between $200-00 and $250-00 would be appropriate in this case.

Reasons for Penalty:

In considering an appropriate penalty we took into account the matters referred to by Mr Ydgren and decided that a fine of $200-00 would be appropriate, and we informed the parties accordingly.
