As the breach was admitted we find the charge proved.

Taking all the above into account we impose a fine of $200.

Facts:

Following race 3 an information was filed pursuant to 610 (4).  The informant Mr N Goodwin alleged that Mr C Ormsby was in possession of a body protector that had been modified.

Submissions for Decision:

Mr Oatham explained to the committee that following race 3 Mr Ormsby was found to be in possession of a vest which had been modified.  Mr Oatham said the vest was in poor condition and some of the lower padding had been removed.

Mr Ormsby said he had bought the vest in Australia as he was told they were the latest and best vests available.  He believed they were also legal in Australia and thought the same would apply here.

Submissions for Penalty:

Mr Goodwin said Mr Ormsby had incurred 2 vest charges in Australia but this was his first in New Zealand.  He submitted a $200 fine would be appropriate.

Mr Ormsby had nothing to add.

Reasons for Penalty:

The committee considered all the evidence and submissions.  We are satisfied that Mr Ormsby did not try to deceive the stewards by his actions but made the mistake by not asking them if the vest was acceptable in New Zealand prior to the races.  As this was Mr Ormsby's first vest charge in New Zealand and he had admitted the breach the committee believes a penalty consistent with previous vest charges of a similar nature is appropriate.
