Mr Callaway is accordingly suspended for 3 race riding days commencing at the conclusion of racing on Saturday 19th April 2014. That period of suspension encompasses meeting at Riverton on 21st April and Blenheim on 24th & 27th April 2014.
Facts:
Following the running of the "Coca-Cola Canterbury Gold Cup" (Group III), Licensed Jockey L Callaway was charged with careless riding.
It was alleged that Mr Callaway shifted inwards approaching the 1800 metres when insufficiently clear of "Our Bee Jay" (K Williams), which resulted in "Our Bee Jay" and the trailing "Grand Admiral" and "Nashville" suffering interference.
Mr Zarb showed the video coverage of the incident to the hearing, using head-on and side-on camera angles. Approximately 200 metres after the start of the race, Mr Callaway, who was drawn 7 in a field of 11, commenced an inward movement. He went across the line of "Our Bee Jay" when not his own horse length and another length clear. The result of this was that Ms Williams was forced to check off the heels of Mr Callaway's mount. As a result of this there was also some consequential interference of a minor nature to "Grand Admiral" and "Nashville".
By way of explanation, Mr Callaway said that he agreed that he was not his own length and another length clear when he went across the line of "Our Bee Jay" , but he did not believe that he caused any inconvenience to "Grand Admiral" and "Nashville". He said that the incident was shortly after the start, and that because of the track conditions that the horses were "moving around".
Submissions for Penalty:
Mr Zarb told the hearing that Mr Callaway has had one previous charge of careless riding in the last 12 months. He was suspended at Southland in February for 3 days. He submitted that Mr Callaway should be given credit for his early admission of the breach, but did point out that the incident occurred in a Group III race which carried a stake of $100,000. The Stipendiary Steward's view was that the degree of careless riding was low to mid-range.
Mr Callaway had no specific submissions to make with regard to penalty. He did, however, apply for a seven day deferment of the coming into effect of the period of suspension.

The starting point for the imposition of penalty, as per the Judicial Control Authority's penalty guide, is a suspension of 5 race riding days. Against that we must take into account, aggravating and mitigating factors.
This was a Group III race for a stake of $100,000. That must be taken into account in terms of Rule 920 (a) & (b), and as a consequence, warrants an uplift on penalty of one day, making our starting point, a suspension of 6 race riding days.
We therefore turn to consider the mitigating factors. Mr Callaway has admitted the breach at an early stage. The degree of carelessness was not great, and there was only minor interference caused to other horses. Even though Mr Callaway does ride on occasions in the North Island, he is primarily a South Island rider. Those three factors enable us to allow Mr Callaway a 3 day discount on our starting point of 6 days.
