As Mr Mudhoo admitted the breach we found the charge proved.

Penalty:

Mr Mudhoo is suspended from the close of racing on Saturday January 21st up to and including racing on Saturday February 4th. This equates to four South Island race days:

26/1/17 - Otago
28/1/17 - Canterbury
2/2/17 - Gore
4/2/17 - Otago

Facts:

Following the running of Race 3, Go Racing Syndications Premier, an Information was lodged by Mr J Oatham alleging a breach of Rule 638(1)(d) in that Krishna Mudhoo angled his mount ELLERSTINA outwards approaching the 400m making solid contact with ISLAND BAY (R Elliott) causing a check to that runner.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Mudhoo confirmed to the Committee that he admitted the breach. Assisting him was his employer Mrs K Parsons.

Mr Goodwin identified the runners involved and showed all three available videos.

Approaching the 400m Mr Mudhoo (ELLERSTINA) angled his mount out abruptly making firm contact with Mr Ryan Elliot’s mount ISLAND BAY. Mr Elliott was forced sharply outwards and both horses became unbalanced as a result of the bumping that occurred between them. Mr Goodwin said it was fortunate that Mr Elliott was not pushed across the heels of Mr Hannam’s mount as the consequences may have been more serious.

Mr Mudhoo said he had ridden ELLERSTINA at its last start and on that occasion it ran out on the bend in a similar manner. As a result the trainer modified the gear and applied cheek burrs for today’s race but this did not appear to make a difference.

Submissions for Penalty:

Mr Oatham produced Mr Mudhoo’s riding record which showed three breaches of the careless riding rule over the previous 12 months.

These were as follows:

11/3/16 - Ashburton - 2 days
17/9/16 - Canterbury - 2 days
5/11/16 - Canterbury -  4 days

Mr Oatham said although the number of suspensions was increasing the stewards were, at this stage, prepared to view Mr Mudhoo’s record as a neutral factor. They assessed the degree of carelessness as above midrange and put forward the submission that a term of suspension in line with the breach was the appropriate penalty.

Mrs Parsons said Mr Mudhoo was excited and neglected to “steer” his horse properly at that stage of the race.

Reasons for Penalty:

In coming to a decision on penalty the committee took into account all of the submissions presented. As this was the first time Mr Mudhoo had ridden in the North Island we used the three day starting point for South Island riders as outlined in the Penalty Guide.

It was our view that Mr Mudhoo’s degree of carelessness sat above midrange. As he rounded the bend for home Mr Mudhoo angled his horse outwards seeking a run where there was no room available for him to go. Having had difficulty with this horse at its last start Mr Mudhoo should have shown more patience but in angling out sharply he caused significant interference to ISLAND BAY. We have applied an uplift of two days to the penalty as a result of his degree of carelessness and the consequences. Safety is absolutely paramount and riders must be deterred from riding carelessly no matter what the circumstances.

In mitigation we have allowed a discount of one day for Mr Mudhoo’s admission of the breach. His record we regarded as a neutral factor.

Mrs Parsons advised of riding commitments at Gore next Saturday January 21st.
