This Committee imposes a fine of $450.00 on Mrs Satherley.

Facts:

Following the running of the FRANKLIN AUCTIONS COUNTIES CUP an Information was lodged by Chief Stipendiary Steward Mr J Oatham against Class A Rider Mrs L Satherley alleging that Mrs Satherley as the Rider of LIVIN' ON A PRAYER used her whip excessively prior to the 100 metres mark.

Rule 638(3)(b)(ii) provides: A Rider shall not strike a horse with a whip in a manner or to an extent which is excessive.

The NZTR Whip Guidelines provide that there is a limitation of 5 strikes of the whip prior to the 100 metres mark.

Mrs Satherley advised that she did not wish to attend the Hearing but that she admitted the breach.

Mr Oatham demonstrated the incident by use of the race films and showed where Mrs Satherley had used her whip 8 times prior to the 100 metres mark.

Submissions for Penalty:

Mr Oathan said that this was Mrs Satherley's first breach of this Rule under the new Guidelines and the starting point penalty was a $300.00 fine. He did say however that this was a Group 3 Race and therefore there should be an uplift in the fine.

Reasons for Penalty:

The number of strikes is very clear. The Committee is concerned about Animal Welfare and also the impression given to those members of the public watching the races who do not like seeing horses being hit with the whip. They do complain to NZTR.

The number of strikes is excessive as far as the Guidelines are concerned and the Committee agrees that there should be an uplift in the fine because this is a Group 3 Race.  The Committee believes that the appropriate penalty is a $450.00 fine.
