Facts:
Following Race 1, Mr Goodwin lodged an Information with the Judicial Committee alleging a breach of Rule 638 (3) (b) (ii) in that B Lammas used his whip excessively prior to the 100 metres.
At the outset of the hearing, Mr Lammas confirmed he understood the Rule and admitted the breach.
Mr Oatham used the videos to count 8 strikes of the whip prior to the 100m mark. Mr Lammas agreed that he had struck his mount three times more than the Guidelines allow.

Mr Goodwin advised the Committee that this was the first breach of the Whip Rule for Mr Lammas within the last 12 months. He further stated that Mr Lammas had not gained anything from his actions.
Mr Lammas said he hadn’t ridden since October but took full responsibility for the breach and had simply misjudged the number of strikes.
Reasons for Penalty:
NZTR revised the Whip Penalty Guidelines in October 2019. When the number of strikes is under 10 the Penalty Guidelines provide a starting point of $300 for a first breach. The Committee was satisfied that Mr Lammas used his whip 8 times. There were no aggravating factors requiring an uplift.
