Facts:

Following the running of Race 4, the Staples & Kidd Junior Drivers Mobile Pace, an Information was filed by Stipendiary Steward, Mr S Renault, against Public Trainer, Mr M House, alleging that “M House failed to have SANTANA MACH in its allocated stall by the prescribed time resulting in it being a late scratching under Rule 213 (l) (h)”.

Mr Renault confirmed Mr House had admitted the breach and that he was not present at the racecourse.

Rule 15 (a) (i) Racemeeting Attendance provides as follows:
(a) The trainer of any horse engaged in any race at a totalisator racemeeting shall ensure that such horse is available with an attendant in the official stabling complex (or in its allocated stall).
(i) at least one hour prior to the advertised starting time of the first race of the meeting where it is entered in that race, or, if entered in a subsequent race, at least ninety minutes prior to the advertised starting time of the race.

Mr Renault gave the Committee the background into the breach which began when he received a phone call from Mr House after race 2 at approximately 12.45pm. Mr House informed him that he had misjudged his day and had realised he was in race 4 not race 7. At the time of the call Mr House said he was at Dunsandel and had another hour of travel which would have him arrive at the racecourse at start time for race 4 which was 1.42 pm.

Mr Renault said to Mr House that he would scratch SANTANA MACH on his behalf and informed the Club of the late scratching. Mr Renault told Mr House that he would be charging him for a breach of the rules.

Mr House told Mr Renault that he admitted the breach and was happy for any hearing to proceed without him and that his driver Mr B Laughton could sign the Information as his agent.

Submissions for Penalty:

Mr Renault said this was an unusual case and there were only two other cases for which we could compare this with. Both were at Addington where trainers Mr D Mitchell and Mr S McRae misjudged their arrival time and their horses were late scratched. They were each fined $400.

Mr Renault said although in this case a horse wasn’t denied a start, the Owner, Driver and the punters were denied their chance and the Club was disadvantage.

For consistency in penalty he said it was the Stewards recommendation that Mr House be fined the sum of $400.

Reasons for Penalty:

The JCA penalty Guidelines for rule 834(2)(a) provides for a fine of $400, but this is when a horse is denied a start. Late scratching penalties are usually dealt with by way of the Minor Infringement Schedule where a horse isn’t denied a start and it provides for a $200 fine starting point.

The Committee regards Mr House’s error as fundamental carelessness by a trainer preparing for a race day.

The aggravating factors arising from this carelessness are, the Owner missed their chance to race as did the driver. The betting public, although reimbursed, missed their opportunity and the Methven Trotting Club was financially disadvantaged.

The Committee found in their archives another case where on the 4 February 2018 Mr P Ellis was late presenting his horse to the stabling area and had his horse late scratched. He was also fined $400.

The Committee having regard for the above factors, considered a fine of $400 was an appropriate penalty in this case.
