As the breach was admitted we find the charge proved.
Penalty:
The committee explained to Miss Collett the starting point for careless riding is now 5 days. However because of the mitigating factors and her low level of carelessness we believe a 1 day concession is appropriate. Accordingly we suspend Miss Collett from riding in races which is to start after racing on 20 February and conclude after racing on 27 February 2011(4 days).

Following race 8 the informant Mr M Williamson alleged that passing the 1800 metres STEFLYNDO (A Collett) shifted in when not clear causing checks to C'EST MAGNIFIQUE (M Cameron) and also MAGIC POTION (J Collett).
Submissions for Decision:
Mr George demonstrated the video films which showed STEFLYNDO ridden by Miss A Collett racing in a midfield position approaching the 1800 metres. At the point of the turn Mr George showed where Miss Collett allowed her mount to shift in crowding C'EST MAGNIFIQUE and MAGIC POTION. He submitted Miss Collett was not the required distance when moving in.
Miss Collett had nothing to say when asked.
Mr R Collett asked the committee to consider the inexperience of the rider when assessing the penalty.

Mr Williamson produced Miss Collett's record which showed only 1 suspension for careless riding in the last 12 months. He said that although the interference to C'EST MAGNIFIQUE was quite severe some of this was due to that horse racing erratically at the time. Mr Williamson submitted Miss Collett's carelessness was at the low end.
Miss Collett told the committee she did not have any commitments after racing at Wairoa on 20 February 2011.

The committee carefully considered all evidence and submissions. In Miss Collett's favour are her admission of the breach, her inexperience and her very good record. However these must be balanced against the interference to 2 horses caused by Miss Collett allowing her mount to move in when insufficiently clear. The committee does find Miss Collett's carelessness to be at the lower end.
