Taking into account all of these factors the protest was dismissed and placings allowed to stand as called by the Judge.

Dividends were directed to be paid accordingly.

Facts:

Following Race 9, The Group 2 Ezibuy Awapuni Gold Cup over 2000m, a protest was lodged pursuant to Rule 642(1) by Mr J Riddell alleging that horse number 3 (MILITARY MOVE) or its rider placed 2nd by the Judge interfered with the chances of horse number 1 (NASHVILLE) placed 3rd by the JUDGE.

The official margin between 2nd and 3rd was ¾ length.

Submissions for Decision:

Mr Riddell told the committee that he and Mr Innes came around the home turn together with NASHVILLE to the inside of MILITARY MOVE. MILITARY MOVE (Mr L Innes) then proceeded to lay in on NASHVILLE for about a dozen strides. Mr Riddell said, as a result of the interference, he couldn’t get balanced and estimated the loss of momentum cost him a couple of lengths.

Mr Bull agreed with Mr Riddell adding that any loss of momentum is significant when carrying 59 ½ kgs. He said NASHVILLE was denied clear running room for some distance which affected its chances of running second.

Mr Innes argued that it was NASHVILLE who first came out and made contact with MILITARY MOVE and it was only following that contact that MILITARY MOVE then laid in on NASHVILLE. Mr Ritchie was of the same opinion and while not disputing that MILITARY MOVE did lay in on NASHVILLE for several strides he asked the committee to look at the last 50m of the race where MILITARY MOVE was pulling away from NASHVILLE.

For the Stewards Mr Neal said initially it was NASHVILLE who moved outwards onto MILITARY MOVE which caused that horse to turn slightly and lean in on NASHVILLE. They came together for several strides but over the final 200m both horses had clear racing room and both riders were able to ride with vigour. Mr Neal concluded by saying the Stewards would not support the protest.

Reasons for Decision:

In coming to a decision the committee carefully considered all of the evidence presented. We were of the opinion that the initial interference on the bend was the result of Mr Riddell moving outwards and making contact with MILITARY MOVE. Thereafter MILITARY MOVE did lay in on NASHVILLE for 6 – 7 strides. The interference between the two horses was not insignificant with Mr Riddell hampered in his ability to use the whip for some strides. In order to uphold the protest however we had to be satisfied that, free of interference, NASHVILLE would have finished ahead of MILITARY MOVE. Of significance was the stage of the race at which the incident happened, the manner in which the horses were finishing and the ¾ length margin at the finish. From the 200m onwards both horses raced free of interference and were being ridden with vigour. Each had equal opportunity yet over the concluding stages MILITARY MOVE was drawing ahead of NASHVILLE.
