Facts:
Following the running of Race 4 (Sistema Stakes Group 1) Information No. A8680 was filed with the Judicial Committee. It was alleged by Mr Oatham that Mr Colgan allowed his mount UJJAYYI to shift inwards when not sufficiently clear, causing crowding to SUPER PHAN, IRISH FLAME, GOLD FEVER and AQUAMOSA with GOLD FEVER and AQUAMOSA being severely checked passing the 1100m.
Mr Colgan acknowledged that he understood the Rule, the charge and confirmed to the committee that he admitted the breach.
Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be; (d) careless
Mr Davidson identified all horses on film replays and said that Mr Colgan pushed his mount forward and moved in onto SUPER PHAN who in turn tightened IRISH FLAME, GOLD FEVER and AQUAMOSA. He said that GOLD FEVER was severely restrained with AQUAMOSA also being badly checked. He said that Mr Colgan was never quite clear and in answer to a question from the Chair, said that he was half a length clear of Miss Spratt’s mount SUPER PHAN.
Mr Colgan said the he did put pressure on Miss Spratt’s mount as she pushed up knowing that she had riders on her inside. Mr Colgan said that Miss Spratt had said to him that she had ridden SUPER PHAN earlier in the week and that it was difficult to control. He said that she had pushed her horse hard up inside him and that that had not helped his cause. He said that his horse is not the best mannered as it hangs in this way (right handed) and hangs out going the opposite way. He said he was upset that they got checked, but that that was the way it ended up.
Submissions for Penalty:
Mr Oatham produced Mr Colgan’s record which showed that he only had two 4-day suspensions for careless riding during the last twelve months, with the most recent being on 25 January 2017. He said it was a relatively good record and that he considered it to be a neutral factor. He said that there was some mitigation due to SUPER PHAN’s racing manners and the relatively short run to the first corner. Mr Oatham placed the carelessness in mid-range, that four runners were affected, that it was a Group 1 Race with a total stake of $200,000. He submitted that a suspension in the 5-6 day range would be appropriate.
Mr Oatham advised the committee that Mr Colgan predominantly rides in the Auckland/Waikato area and has no history of riding at industry days in the Central Districts.
Mr Colgan said that he had rides on Saturday 18 March and confirmed that he did not ride at industry days in the Central District.
Reasons for Penalty:
The committee was mindful of the JCA starting point of 5 riding days suspension.
The aggravating factors were the degree of carelessness which the committee placed just above mid-range, the consequences of such carelessness resulted in four horses being affected with two being severely interfered with. One of these horses, GOLD FEVER, recovered particularly well to finish in 3rd placing.
A further aggravating factor was that it was a Group 1 Race with a total stake of $200,000.
The mitigating factors were the good riding record and the admittance of the breach, for which credit was given.
After giving due consideration to all matters in relation to penalty, the committee determined that a 6 riding-day suspension be imposed.
