Decision:

As the race meeting proceeded without incident, it was not necessary for the Committee to make any ruling and the request was, accordingly, dismissed.

Facts:

Prior to the running of Race 1, the Wilsons Hotel/Reefton Motors Pace, an Information for a Request for a Ruling was filed by Stipendiary Steward, Mr N M Ydgren, in that whether the meeting should start as programmed.

The Information reads as follows:

I, the above named informant seek a ruling in relation to Rule 1102(2)(a)(ii) from the Judicial Committee that whether the meeting start as programmed.

Rule 1102(2)(a)(ii) reads as follows:

(2)(a) from one hour prior to the advertised starting time of the first race of any day of a race meeting until after the conclusion of the last proceeding which it commences to deal with on that day, or thirty minutes after the last race run on that day(whichever is the later)to:-

(ii) determine any question as to whether that day of racing or any part thereof should be postponed, abandoned or cancelled.

Submissions for Decision:

Mr Ydgren gave submissions on his concern with the safety of the track. He stated that on inspection of the track this morning he was concerned at the number of bare patches on the track especially on the running line where repairs had been made after the last meeting here in late December 2011. He stated that the concern he had was in regard to horses shying or jumping at the patches during a race which he submitted was a safety issue.

Club President Mr A W Thomas stated that the track had been inspected by Stewards and Mr Denton, Harness Racing New Zealand’s track inspector, on two occasions over the past two weeks with Mr Denton advising that it would be suitable to race on. Mr Denton had explained to Mr Thomas that as the patches were continuous around the track, horses were unlikely to shy or baulk as they would with a single patch.

All drivers present made submissions on the track conditions with some stating concerns that the track should not have been passed to race as it was presented. They were all of the opinion that the horses for race 1 should go out for their preliminaries, cut up the ground on the inside and test the track out in the first instance.

Reasons for Decision:

After discussion it was agreed by all parties that this procedure be followed with all drivers reporting to the Stewards at the start how their respective horses handled the track during the warm up and if there were any issues.

All drivers in Race 1 reported back to the Stewards after their preliminaries with all horses handling the conditions and no concerns being raised in regard to the track.

All drivers were again questioned by the Stewards after the race with no concerns with track conditions being raised.
